This Rewards Policy (this “Policy”) governs the availability and operation of promotional reward incentives (including, where offered, third-party digital gift cards and/or redemption codes) made available in connection with the Kuki-Kuki service at https://www.kuki-kuki.com (the “Service”). This Policy is incorporated by reference into, and forms part of, the Kuki-Kuki Terms and Conditions (the “Terms”). Capitalised terms not defined herein have the meanings given to them in the Terms.
Order of precedence. In the event of a conflict between this Policy and the Terms, the Terms shall prevail unless expressly stated otherwise.
1. Definitions
For purposes of this Policy:
- “Account Owner” means the Parent/Guardian who creates, manages, and controls the parent-managed account and associated Child profiles.
- “Child” means a minor user (ages 6-17) using the Service under a parent-managed account.
- “Child Profile” means the profile created for a specific Child under an Account Owner’s parent-managed account.
- “Issuer” means the third party that issues and is responsible for any gift card, code, voucher, or equivalent reward instrument.
- “Milestones” means educational activity thresholds, achievements, or eligibility conditions determined by us from time to time and communicated within the Service.
- “Rewards” means promotional incentives made available by us in connection with participation in the Service, which may include third-party digital gift cards/codes and/or other non-cash benefits, subject to eligibility, limitations, and availability.
2. Nature and Legal Character of Rewards; No Financial Services
2.1 Promotional Programme. Rewards are offered solely as a promotional/loyalty-style programme intended to encourage participation in extracurricular educational activities. Rewards do not constitute compensation, wages, or consideration for services.
2.2 Not Money; No Stored Value; No Cash Value. Rewards (for example, third-party digital gift cards or codes delivered to the Child) are not: (a) money or legal tender; (b) electronic money (e-money); (c) a payment account or stored-value account held with us; (d) redeemable for cash; (e) interest-bearing; or (f) a financial product or financial service provided by us. The Wallet Credits used to fund Rewards are stored-value balances on the Service governed by the Terms and are distinct from Rewards themselves.
2.3 No Monetary Conversion by Us. Rewards cannot be exchanged for currency by us and have no cash value as between you and us.
2.4 Third-Party Instruments. Where a Reward is delivered as a third-party instrument, it is issued and administered by the Issuer and subject to Issuer terms, restrictions, and availability.
3. Eligibility; Multiple Children per Account; Supervision
3.1 Eligible Participants. Rewards are available only to children aged 6-17 using the Service under a parent-managed account.
3.2 Multiple Children per Parent Account. A single Account Owner may maintain multiple Child Profiles. Unless expressly stated otherwise within the Service, Rewards are tracked, earned, and redeemed per Child Profile.
3.3 Parental Control and Supervision. The Account Owner remains responsible for supervising the Child’s use of the Service and for managing access to the account and Child Profiles (including credential confidentiality and device access). However, no Account Owner confirmation is required for redemption (see Section 5).
3.4 Programme Limits. We may limit Rewards availability or eligibility by country/region, age band, account standing, anti-fraud requirements, or other reasonable criteria determined by us from time to time.
4. Earning Rules; No Chance; No Gambling
4.1 Milestone-Based Only. Rewards may be earned solely through educational participation and completion of Milestones.
4.2 No Chance-Based Awards. Rewards are not awarded by chance and are not a lottery, sweepstakes, raffle, or gambling product.
4.3 Programme Rules Incorporated. Specific Milestones, thresholds, conversion rules, caps, and limitations are established and displayed within the Service and are incorporated by reference into this Policy.
5. Redemption; Delivery; Immediate Child Access; Region Selection
5.1 Immediate Delivery Upon Eligibility. Subject to eligibility and anti-fraud controls, once a Child Profile satisfies applicable Milestones, the corresponding Reward will be delivered immediately within the Service and made accessible to the Child Profile (for example, by displaying a redemption code or equivalent within the Child’s account experience).
5.2 No Parent Confirmation. The Account Owner acknowledges and agrees that Rewards may be made available to the Child Profile without any separate confirmation, approval, or authorisation step by the Account Owner at the time of redemption.
5.3 Region-Specific Availability; Account Owner Responsibility. Rewards are region-specific and may be restricted by Issuer coverage, local availability, and regional rules. The Account Owner is solely responsible for selecting and maintaining the correct region associated with the parent-managed account and/or Child Profiles, as applicable. If an incorrect region is selected, a Reward may be unavailable, non-redeemable, or rejected by the Issuer. To the maximum extent permitted by law, we shall not be responsible or liable for redemption issues arising from an incorrect region selection by the Account Owner.
5.4 Additional Conditions. Redemption may be subject to additional conditions communicated within the Service, including minimum thresholds, maximum redemption limits, processing times, account standing requirements, and/or anti-fraud review.
5.5 No Guarantee of Continuous Availability. Rewards, Issuers, and redemption options may be limited in quantity, time, or geography and may become unavailable due to third-party constraints.
6. Issuer Terms; Third-Party Responsibility
6.1 Issuer Terms Govern Use. Third-party Rewards are subject to the Issuer’s terms and conditions.
6.2 No Issuer Liability Assumption. We do not control and are not responsible for Issuer outages, programme changes, redemption rules, or refusal to honour a code for reasons beyond our control, except to the extent caused by our breach of this Policy or the Terms and not otherwise excluded by mandatory law.
6.3 Code Security. Once delivered within the Child Profile, you are responsible for safeguarding account access and any codes. We are not responsible for unauthorised use of codes resulting from compromised credentials or device access, except where required by mandatory law.
7. Restrictions; Anti-Fraud; Multiple Child Profiles
7.1 Prohibited Conduct. You must not (and must not permit any Child to) manipulate or attempt to manipulate Milestones or Rewards, including by automated activity, false activity generation, exploitation of bugs, or account sharing intended to circumvent limits.
7.2 Cross-Profile Restrictions. Unless expressly permitted by us, Rewards earned under one Child Profile may not be transferred to another Child Profile (including within the same parent account), and may not be sold or exchanged.
7.3 Investigations and Remedies. We may investigate suspected violations and may, in our reasonable discretion, delay, withhold, suspend, reverse, or cancel Rewards; require additional verification; and/or suspend or terminate access to Rewards and/or the Service, in each case in a proportionate manner.
8. Expiry; Forfeiture; No Liability for Failure to Redeem
8.1 Expiry Rules. Rewards may be subject to expiry/forfeiture under programme rules and/or Issuer terms.
8.2 No Liability. To the maximum extent permitted by law, we shall have no liability for any expiry, forfeiture, or loss of a Reward due to failure to redeem within the applicable period, including where such result arises from Issuer terms, regional restrictions, account settings, or user inaction.
9. Modification; Suspension; Discontinuation
9.1 Right to Modify. We may modify Rewards, Milestones, earning rules, redemption options, caps, and eligibility criteria at any time for operational, legal, security, or business reasons.
9.2 Material Impact Notice. Where changes materially affect users, we will provide notice within the Service where reasonably practicable.
9.3 Discontinuation. We may suspend or discontinue the Rewards programme in whole or in part at any time. Discontinuation will not create an obligation to provide substitute rewards or compensation except where required by mandatory law.
10. Taxes and Compliance
The Account Owner is solely responsible for determining whether any taxes, reporting obligations, or other compliance requirements apply in connection with Rewards and for complying with applicable laws.
11. Relationship to Wallet Deposits and Refunds
11.1 Not a Refund or Cash Equivalent. Rewards do not constitute a refund, credit, discount, rebate, or cash equivalent of Parent Wallet deposits.
11.2 Deposit Independence. Parent Wallet deposits and withdrawals remain governed by the Terms, including any non-refund provisions subject to mandatory consumer law.
12. Privacy
Rewards administration requires limited processing of milestone and redemption events, as described in the Privacy Notice, and is designed to be data-minimised and parent-controlled.
13. Disclaimers (Rewards Programme)
13.1 As-Available. Rewards are offered on an “as available” basis. We do not warrant continuous availability of any Reward type, Issuer, or redemption option.
13.2 No Warranty of Redemption Success. We do not warrant that redemption will be successful in all circumstances, particularly where redemption depends on Issuer systems, regional restrictions, or user settings.
14. Limitation of Liability (Rewards)
To the maximum extent permitted by law, we shall not be liable for indirect, incidental, special, consequential, or punitive damages arising out of or relating to Rewards. Our aggregate liability (if any) in connection with Rewards is limited as set out in the Terms, and nothing in this Policy limits liability where prohibited by mandatory law.
